The Legality of CBD in Idaho

IS CBD OIL LEGAL IN IDAHO?

Is CBD oil legal in Idaho? The short answer is – yes. There is some confusion, however, amongst the general population and the law enforcement community. A quick look at the code will shed some light on the subject.

IDAHO CODE

Basically, the Idaho code states that any substance that has THC (Tetrahydrocannabinol – the psychoactive ingredient in marijuana) as an ingredient, regardless of the amount, is considered marijuana, a class one drug in Idaho. We witnessed this in action when two trucks transporting hemp, which had .3% THC, were stopped and the drivers arrested for transporting marijuana. 

FARM BILL MAKES HEMP LEGAL

Hemp, with a maximum of .3% THC, is legal in forty-seven states. Idaho is one of the states where hemp with a .3% THC level is not legal. Therefore, it cannot even be transported across the state. Any substance containing any THC is illegal. Rice pudding, if it contained any THC, would be considered marijuana and would then be illegal in Idaho.

NO THC MAKES CBD LEGAL IN IDAHO

CBD oil that has no THC is legal in Idaho. One can sell and posses CBD oil as long as it has no THC in it. One of the challenges of buying CBD, especially online, is the question of its percentage of THC. If it contains any THC it is illegal.

PASSING URINE TEST WHILE USING CBD

In addition, any level of THC will show up on urine tests as marijuana and could disqualify the user from employment. Only CBD that has no THC will pass a urine test for THC. 

BE CERTAIN OF THE PRODUCT YOU ARE PURCHASING.

It is incumbent upon everyone using CBD oil for a variety of conditions to ensure that the product they have purchased contains no THC. If it contains any THC it is illegal in Idaho. Buy only from establishments that can produce Certificates of Analysis from independent laboratories indicating the exact amount of CBD in the product as well as the other ingredients. The COA will indicate how much, if any, THC in contained in the product. In this sense, buyer beware, is an applicable warning.
